Welcome to the Starpower Group, LLC d/b/a Alek Carrera Group website (the “Website”), owned and operated by Starpower Group, LLC d/b/a Alek Carrera Group (“Starpower Group, LLC / Alek Carrera Group,” “we,” “us,” or “our”). We provide you access to the Website and those services made available through the Website (together with the Website, the “Services”) subject to the following terms and conditions, as amended by us from time to time without notice (the “Terms of Use”). BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS OF USE AND THE TERMS AND CONDITIONS OF OUR PRIVACY POLICY, WHICH ARE INCORPORATED BY REFERENCE (COLLECTIVELY, THE “AGREEMENT”). IF YOU DO NOT AGREE TO ANY OF THE TERMS OF THE AGREEMENT, YOU MAY NOT ACCESS OR USE THE SERVICES. THE SECTIONS BELOW TITLED “BINDING ARBITRATION” AND “CLASS ACTION WAIVER” CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. THEY AFFECT YOUR LEGAL RIGHTS. PLEASE READ THEM CAREFULLY. Capitalized terms not defined in these Terms of Use shall have the meaning set forth in the Privacy Policy.

1. THE SERVICES AND USERS

The Website provides information to visitors and registered users about Starpower Group, LLC / Alek Carrera Group, our real estate listings, and our Services. Through the Services, users may search listings posted by our agents (“Agents”). Visitors do not need to register and may explore publicly available content, including listings, and may contact us through the Website. Registered users may save listings and manage favorites. When creating an account, you must provide true, accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your username, password, and any identifiers. You are responsible for all activities occurring under your credentials. We may delete or change your credentials at any time for any reason without liability. If you are an Agent, you may be subject to a separate written agreement (the “Brokerage Agreement”). In the event of conflict, the Brokerage Agreement prevails.

2. ACCESS

The Services are intended solely for individuals aged 13 years or older. Users under 13 may not use the Services or submit personal information. If you are 13 or older but under the age of majority, you may use the Services only with the consent and supervision of a parent or guardian who agrees to be bound by these Terms. We may deny access to the Services, or close or deactivate accounts, at any time, for any reason or no reason, without liability. We grant you a limited, non-transferable, non-exclusive license to access and use the Services solely for personal, non-commercial use. You agree not to violate any applicable law; use the Services to collect market research for a competing business; impersonate any person; interfere with the Services; access data without authorization; reverse engineer, disassemble, or copy code; obscure or interfere with advertisements; use automated tools; impose unreasonable load; resell or sublicense the Services; remove proprietary notices; or upload harmful code. We may suspend or terminate your license at any time.

3. MODIFICATIONS TO THE SERVICES

We may modify, suspend, or discontinue the Services at any time, with or without notice, and without liability to you.

4. ACKNOWLEDGMENT OF BROKER-CONSUMER RELATIONSHIP

By using the Services, you acknowledge that you may be entering into a lawful broker-consumer relationship as defined under applicable state law. The relationship is not exclusive, and you are not obligated to work with Starpower Group, LLC / Alek Carrera Group. Any actual brokerage services will be governed by a separate written agreement.

5. INTELLECTUAL PROPERTY

The Services and all materials provided through them (the “Content”) are protected by copyright, trademark, and other laws. We and our licensors exclusively own all rights, title, and interest in and to the Services and Content. You may view the Content for personal, non-commercial use only. No other use is permitted without prior written consent. You may not sell, reproduce, distribute, modify, publicly perform, or create derivative works. Trademarks may not be used without our prior written permission. All goodwill arising from use of our marks inures to us. We may freely use feedback you provide without compensation.

6. REAL ESTATE INFORMATION & DISCLAIMERS

Nothing on the Services constitutes an offer to sell, lease, or otherwise transfer any property. Any transaction will be governed solely by a separate written agreement. All real estate information is subject to change without notice and may be based on third-party sources. You are responsible for verifying information material to your decision, including dimensions, pricing, availability, and conditions. The Services do not provide legal, tax, accounting, financial, or investment advice. Consult qualified advisors. We comply with all applicable fair housing and anti-discrimination laws.

7. USER CONTENT

You are solely responsible for any content you submit (“User Content”). You may not submit content that is unlawful, defamatory, infringing, spam, or harmful. By submitting User Content, you grant us a worldwide, royalty-free, sublicensable license to use such content in connection with operating the Services. We may remove or modify User Content at any time.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Starpower Group, LLC / Alek Carrera Group and its affiliates from any claims, damages, losses, or expenses arising out of your use of the Services, your violation of these Terms, your User Content, or your violation of any rights of third parties.

9. NO WARRANTIES; LIMITATION OF LIABILITY

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED USD $100. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS; IN SUCH CASES, THOSE PROVISIONS MAY NOT APPLY TO YOU.

11. COMPLIANCE WITH APPLICABLE LAWS

The Services are based in the United States. You are solely responsible for compliance with laws applicable to your jurisdiction.

12. CONTROLLING LAW

This Agreement will be governed by the laws of the State of California, USA, without regard to conflict of laws provisions. If you are accessing the Services from Mexico, certain mandatory provisions of Mexican law may also apply.

13. BINDING ARBITRATION

For US residents, any dispute will be resolved by binding arbitration under the Federal Arbitration Act. Arbitration may be conducted in person, by phone, online, or by documents. If in person, it will occur in the county where you reside. Either party may seek provisional remedies in court.

14. CLASS ACTION WAIVER

YOU AGREE THAT ANY PROCEEDING WILL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. NO CLASS ACTION OR REPRESENTATIVE ACTION IS PERMITTED.

15. EQUITABLE RELIEF

We may seek injunctive relief in California courts to prevent violations of our intellectual property rights. You consent to such jurisdiction.

16. EXTERNAL SITES

We are not responsible for content on third-party websites. Use them at your own risk.

17. TERMINATION

We may modify, suspend, or terminate your access at any time. Upon termination, all licenses granted cease. Sections that naturally survive shall survive termination.

18. CHANGES TO THESE TERMS OF USE

We may update these Terms at any time without notice. Your continued use constitutes acceptance.

19. GENERAL

No failure to exercise a right constitutes a waiver. If any provision is invalid, the remainder remains in effect. You may not assign these Terms. We may assign them without restriction. These Terms constitute the entire agreement and supersede prior agreements.
